1. About this Policy
This Refund & Cancellation Policy ("Policy") explains how billing, auto-renewal, cancellation, and refunds work for paid access to HyperFX (the "Service"). It forms part of, and should be read together with, our Terms of Service, Privacy Policy, Risk Disclosure, and Affiliate Disclosure. Capitalized terms not defined here have the meaning given in our Terms of Service.
By purchasing or renewing any paid plan, you agree to this Policy. If you do not agree, do not purchase a subscription or other paid plan.
1.1 What HyperFX is — and is not
HyperFX is an information and educational resource only. The Service includes AI-assisted analysis of user-uploaded chart screenshots, a trade journal, strategy/setup feeds, and tracking of public traders' prediction accuracy for crypto and forex markets.
HyperFX provides no financial, investment, or trading advice, no personalized recommendations, no solicitation or offer to buy or sell any asset, and no portfolio management. We are not a broker, exchange, financial advisor, or fiduciary, and we are not regulated or authorized by any financial authority unless expressly stated.
We make no guarantee of profit, accuracy, or any outcome, and we do not publish or promise any "typical results." Crypto and forex are high-risk: you can lose all of your capital, leverage magnifies losses, and past performance does not indicate future results. AI output may be inaccurate or wrong, and you must independently verify everything. This Policy concerns billing and refunds only; it does not modify or limit any of these disclaimers. The price you pay is for access to information, software, and tools — not for any trading result, signal accuracy, or financial benefit. Dissatisfaction with market outcomes, trading losses, or the accuracy of AI-generated or third-party content is not a basis for a refund.
1.2 Affiliate and referral commission disclosure
HyperFX and/or its users may earn commissions, credits, or other compensation through affiliate or referral links to third-party brokers, exchanges, or other services. Where such links appear, they are disclosed. These links are not endorsements, recommendations, or solicitations to open an account, deposit funds, or trade with any third party, and HyperFX does not control and is not responsible for those third parties. Any referral credits you may earn are governed by Section 3.4. For full details, see our separate Affiliate Disclosure.
2. Payment in cryptocurrency
2.1 Payment method and contracting party
All subscriptions, lifetime plans, credit packs, and other paid access to HyperFX are paid in cryptocurrency (USDT or USDC) and are processed through a third-party, non-custodial crypto payment processor. HyperFX does not accept card payments. Prices are shown in US dollars (USD) and are paid in the equivalent amount of cryptocurrency. The crypto payment processor facilitates on-chain payment collection and provides related transaction records.
The seller and contracting party for your purchase is HyperFX. HyperFX is the entity legally responsible for the sale and for the underlying refund and consumer obligations and for the contract you enter into. If you have any question about your purchase, contact us at support@hyperfx.pro.
2.2 HyperFX is not a payment institution; crypto payments are non-reversible
HyperFX is not a payment institution, money-services business, money transmitter, or e-money issuer, and does not process card payments or hold, transmit, or custody regulated funds. Payment collection is performed through a third-party, non-custodial crypto payment processor.
- We do not receive or store your card details or banking details; HyperFX does not accept cards, and the crypto payment processor is non-custodial.
- Cryptocurrency transactions are recorded on-chain and, once confirmed, are final, irreversible, and non-refundable by the network. There are no card chargebacks or payment-network reversals. Any refund we approve is therefore made manually, as described in Sections 5 and 8.
- Your payment is also subject to the crypto payment processor's applicable terms and policies. Those operational rules govern only the technical and operational mechanics of how a transaction is executed and in no event reduce, waive, or override your mandatory statutory rights, or HyperFX's obligations as the seller / contracting party.
- Applicable taxes and VAT/GST may be added or charged separately depending on your location, as required by law.
- All prices are shown in USD and paid in the equivalent amount of cryptocurrency. Blockchain network (gas) fees, and any exchange or conversion costs you incur when acquiring or sending cryptocurrency, are your responsibility and are not refundable by us.
3. Plans, auto-renewal, and price changes
3.1 Subscription plans
Paid plans may be offered on a recurring basis (for example, monthly or annual) at the prices and with the features shown at checkout. Your access to paid features is contingent on your subscription being active and paid.
3.2 Auto-renewal
Subscriptions renew automatically. Unless and until you cancel, your Pro or Elite subscription is set to renew automatically at the end of each billing cycle at the then-current price, and a renewal payment in cryptocurrency (USDT/USDC) becomes due on each renewal date until you cancel. The new billing period begins once the renewal payment is confirmed. The one-time Lifetime plan and credit packs do not renew.
- A monthly plan renews every month; an annual plan renews every year (or on whatever cycle is displayed at checkout).
- By subscribing, you consent to these recurring charges until you cancel.
- It is your responsibility to make each renewal payment when due. If a renewal payment is not made, your access may be suspended or downgraded until payment is completed.
3.3 Price changes
We may change subscription prices, plan features, or billing cycles. Where required by law, we will give you reasonable advance notice (we aim for at least 30 days before your next renewal) of any price increase that would apply to your plan. Price changes take effect on your next billing cycle after the notice period. If you do not agree to a new price, you may cancel before the change takes effect; continuing to use the Service after the change takes effect constitutes acceptance of the new price.
3.4 Free trials, referral credits, and promotions
- If a free trial is offered, it will convert into a paid, auto-renewing subscription at the end of the trial unless you cancel before the trial ends. The applicable price and conversion date are disclosed at sign-up.
- Referral credits, discounts, and promotional pricing are applied as described at the time of the offer, are not exchangeable for cash, and have no independent monetary value. Referral credits may be earned through our referral program and/or through affiliate or referral links as described in Section 1.2; such links may also earn HyperFX a commission and are not endorsements of any third party. Referral credits and promotional discounts are not refundable and are not separately reimbursed if a subscription is cancelled or refunded. A refund (where granted) is calculated on the amount actually paid, net of any credits, discounts, or promotions applied.
4. How to cancel
You can cancel the renewal of your subscription at any time to stop future charges.
1. Log in to your account and open your billing / subscription settings. 2. Select the HyperFX subscription you wish to cancel and choose Cancel (or "Turn off auto-renewal"). 3. Follow the on-screen confirmation. You should receive confirmation of the cancellation by email or in-app.
You may also cancel by emailing us at support@hyperfx.pro from the email address associated with your account. If you have any difficulty cancelling, contact us at support@hyperfx.pro and we will assist you in completing the cancellation.
4.1 Effect of cancellation
- Cancellation stops future auto-renewal charges.
- Unless a refund is separately granted under this Policy or required by law, you retain access to paid features until the end of your current paid billing period, after which your subscription will not renew and paid access will end.
- Cancellation does not automatically generate a refund for the current period already paid.
- After paid access ends, you may lose access to paid features and certain stored data associated with paid features. Where the Terms of Service provide a data-export window, you may export your data (for example, journal entries) during that window. See the Terms of Service for details on data retention and deletion.
4.2 Termination by us
If we suspend or terminate your account for breach of our Terms of Service, abuse, fraud, or unlawful conduct, you are not entitled to a refund for the remaining subscription period, except where a refund is required by mandatory law.
5. Refund eligibility (digital service) — case-by-case
The Service is a digital service / digital content delivered electronically and made available immediately upon purchase. Because access and value are delivered as soon as your plan is activated, and because cryptocurrency payments are non-reversible (there are no card chargebacks or network reversals):
Refunds are not automatic. Payments for HyperFX are generally non-refundable once access to the paid Service has been granted. However, because crypto payments cannot be reversed on-chain, HyperFX reviews any refund or cancellation request on a case-by-case basis at its sole discretion, in addition to honouring any refund required by mandatory consumer-protection law that applies to you (including the EU/UK withdrawal rights in Section 6). Where a refund is approved, it is processed manually as described below and in Section 8.
This means, for example:
- We do not provide automatic or pro-rated refunds for the unused portion of a billing period after you cancel (separate from the statutory pro-rata rule in Section 6.1(b), which applies where it is mandatory); such requests are considered case-by-case at our discretion.
- We generally do not refund a renewal charge simply because you forgot to cancel before the renewal date (though we may, at our discretion, consider requests made promptly after an unintended renewal — see Section 8).
- Trading losses, market outcomes, the accuracy of AI-generated analysis, and the accuracy of third-party or parsed content are never grounds for a refund.
How an approved refund is paid. Because crypto transactions are irreversible, any refund we approve is sent manually as the applicable amount in USDT or USDC to a wallet address you provide. Blockchain network fees may be deducted from the amount refunded. You are responsible for providing a correct wallet address on a compatible network; we are not responsible for funds sent to an incorrect address you supply.
Nothing in this Section removes or limits any mandatory statutory rights you may have as a consumer, including the EU/UK withdrawal rights described in Section 6.
5.1 Monthly vs. annual plans
- Monthly plans: generally non-refundable once the billing period has started; cancellation stops the next renewal.
- Annual plans: generally non-refundable once access has begun, subject to mandatory consumer rights (including the cooling-off rights and pro-rata rule in Section 6 for eligible consumers); cancellation stops the next annual renewal.
6. EU / UK statutory right of withdrawal (14-day cooling-off)
If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you may have a statutory right to withdraw from a distance contract within 14 days without giving a reason ("cooling-off period"). The cooling-off period generally starts on the day the contract is concluded for a service or digital content.
6.1 How the withdrawal right applies to digital purchases
The way the 14-day right applies depends on the type of purchase. In all cases, before any immediate supply begins, we ask you at checkout to give your prior express consent that performance should begin during the 14-day period, and to acknowledge the consequences of that consent. We confirm your contract and that consent on a durable medium (for example, by email).
(a) One-off / lifetime digital purchases. For a single, one-off digital purchase (for example, a lifetime plan) supplied immediately, you *lose the right of withdrawal only once the service has been fully performed***, and only where that full performance began with your prior express consent and your acknowledgement that you would lose the right once fully performed. Mere commencement of access does not, by itself, extinguish the right unless and until the service has been fully performed.
(b) Ongoing subscriptions (monthly / annual). An ongoing, recurring subscription is by definition not "fully performed" at the moment of purchase, because performance continues throughout the billing period. Accordingly, your *right of withdrawal is not extinguished merely because access has begun.* If you have given prior express consent to start the subscription during the cooling-off period and you then withdraw within the 14 days, the contract ends and:
- you are not required to pay for the full period; instead, you pay only a pro-rata amount in proportion to the service actually supplied up to the moment you communicate your withdrawal, measured against the full contract price (consistent with Article 14(3) of the EU Consumer Rights Directive); and
- we will refund the balance of any amount you paid, in accordance with Section 6.3.
Nothing in this Policy purports to make you waive, forfeit, or lose the withdrawal right for an ongoing subscription merely because the Service was "begun." Any term to that effect does not apply to the extent it conflicts with your mandatory rights.
6.2 Cancellation in addition to withdrawal
Separately from any withdrawal right, you can cancel at any time to prevent future renewal charges (Section 4). Cancellation and the statutory withdrawal right are independent: exercising one does not waive the other.
6.3 How to exercise a withdrawal right
To withdraw within the cooling-off period, send a clear statement of your decision to withdraw to support@hyperfx.pro, including your name, account email, and order/transaction reference. You may use any clear written statement; a model withdrawal form is available on request. We will acknowledge your request and, where the right applies, process any due refund (net of any pro-rata amount payable under Section 6.1(b)) without undue delay and within the period required by applicable law (typically within 14 days of being informed of your decision). Because the original payment was made in cryptocurrency and crypto transactions are irreversible, any refund is sent manually in USDT or USDC to a wallet address you provide (any blockchain network fee may be deducted), unless otherwise agreed or unless applicable law requires a different method.
6.4 Other jurisdictions
Consumers in other countries may have their own mandatory refund, cancellation, or cooling-off rights. Nothing in this Policy limits any rights that cannot be limited under the law applicable to you.
7. Lifetime plan terms
If a "lifetime" plan is offered, the following terms apply in addition to the rest of this Policy:
- A one-time payment grants access to the applicable Service features for the lifetime of the product/service, not the natural lifetime of the purchaser. "Lifetime" means for as long as HyperFX continues to operate and offer the relevant Service, subject to our Terms of Service.
- A lifetime plan does not guarantee that any specific feature, integration, data source, or third-party dependency will remain available indefinitely. Features may change, be added, or be discontinued over time.
- A lifetime plan does not guarantee perpetual operation of HyperFX. If the Service is discontinued, your lifetime access ends, and — except where a refund is required by mandatory law — no pro-rated or residual refund is owed.
- Lifetime plans are a one-off digital purchase and are subject to the refund principles in Section 6.1(a): generally non-refundable once the service has been fully performed following your prior express consent and acknowledgement, and otherwise subject to the EU/UK statutory withdrawal rights in Section 6 and any other mandatory consumer rights.
- Lifetime access is tied to your account, is for a single user, and is non-transferable except as expressly permitted by us in writing.
8. How to request a refund
If you believe you are entitled to a refund, or wish to ask for a discretionary refund, please contact us before initiating any chargeback or payment dispute:
1. Email support@hyperfx.pro from the email address associated with your account. 2. Include: your account email, the plan purchased, the date and amount of the payment, the on-chain transaction reference (transaction hash) where available, and the reason for your request. 3. We will review your request on a case-by-case basis and respond, normally within a reasonable period after receiving the required information.
Refund decision and method. Refunds are not automatic and are approved at our discretion (in addition to any mandatory statutory right). Because cryptocurrency payments are irreversible, any refund we approve is processed manually by sending the applicable amount in USDT or USDC to a wallet address you provide (on a compatible network). Blockchain network (gas) fees may be deducted from the refunded amount. The time for the refund to arrive depends on the relevant blockchain network. Fees you incur to receive or convert the cryptocurrency, and losses from an incorrect wallet address you supply, are outside our control and are not separately reimbursed.
We may decline refund requests that fall outside this Policy and outside your mandatory statutory rights, including (without limitation) requests based on trading losses, market performance, AI or third-party content accuracy, failure to cancel before renewal, or breach of our Terms.
9. Payment disputes
We take payment concerns seriously and ask that you contact us first at support@hyperfx.pro so we can resolve the issue directly and, where appropriate, review a refund request on a case-by-case basis.
- No card chargebacks. Because payments are made in cryptocurrency and are settled on-chain, they are final and non-reversible. Card chargebacks and payment-network reversals do not apply, and there is no card issuer or bank through which to reverse a confirmed crypto payment.
- The correct route to raise a payment concern or seek a refund is to contact us directly at support@hyperfx.pro, so we can review it on a case-by-case basis under Sections 5, 6, and 8.
- If we suspect fraud or abuse in connection with a payment, we may suspend or terminate your account and revoke access to the Service while we investigate.
- Savings clause. Nothing in this Section penalizes, or may be treated as a breach by, a consumer who is exercising a legitimate statutory refund or withdrawal right (including the rights in Sections 5 and 6) or any other right provided by mandatory law. Where you are entitled to a refund under Sections 5 or 6, requesting or pursuing it after first contacting us is not a breach of this Policy or our Terms, your account will not be terminated, and no recovery will be sought, on account of such a legitimate claim.
10. Complaints and dispute resolution
If you have a complaint about billing, cancellation, or a refund, please first contact us at support@hyperfx.pro so we can try to resolve it directly. We aim to acknowledge complaints promptly and to resolve them within a reasonable time.
- EU consumers: Where required, you may be entitled to use consumer Alternative Dispute Resolution (ADR) and the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr, to seek an out-of-court resolution. Subject to applicable law, we are not obliged to participate in ADR unless required; we will indicate whether we agree to do so.
- UK consumers: You may also have access to ADR schemes and the rights available to you under UK consumer law.
- Using these mechanisms does not remove any of your statutory rights, and you may also pursue remedies before the competent courts.
11. Changes to this Policy
We may update this Policy from time to time to reflect changes in our practices, our crypto payment processor, or applicable law. The "Last updated / Effective date" at the top will indicate the latest version, and we will keep an archive of prior versions. Where changes are material, we will provide notice as required by law (for example, by email or in-app notice). Changes apply to purchases and renewals occurring after the new Policy's effective date; they do not retroactively change the refund terms of a completed transaction.
12. Languages
HyperFX provides this Policy in English (EN), Russian (RU), and Spanish (ES). If there is any conflict or inconsistency between language versions, the English version shall prevail to the extent permitted by applicable law. Consumers retain any mandatory rights to be addressed in their own language where local law so requires. The RU and ES translations must reflect, with full parity, the same positioning and clauses as this EN version, including the information-only / no-advice / no-guarantee statements (Sections 1.1 and 5), the affiliate / referral commission disclosure (Section 1.2), and the consumer withdrawal and pro-rata rules (Section 6).
