This Disclaimer & Risk Warning (the "Disclaimer") governs your access to and use of the HyperFX platform, website, applications, content, tools, and related services (collectively, the "Service"), operated by HyperFX ("HyperFX," "we," "us," or "our").

By accessing or using the Service, you confirm that you have read, understood, and agreed to this Disclaimer in full. If you do not agree with any part of this Disclaimer, you must not access or use the Service. This Disclaimer is incorporated into and forms part of our Terms of Service and should be read together with our Privacy Policy, Cookie Policy, and Refund Policy.

We may amend this Disclaimer at any time. Changes take effect when posted with an updated effective date, and your continued use of the Service constitutes acceptance of the amended Disclaimer.

2. Information and Education Only — Not Financial Advice

HyperFX is an information and educational resource only. Everything made available through the Service — including, without limitation, AI-assisted analysis of user-uploaded chart screenshots, the trade journal, strategy and setup feeds, market data, "Trader Intelligence" accuracy tracking, articles, tutorials, and any other content (collectively, the "Content") — is provided strictly for general informational and educational purposes.

The Content does NOT constitute, and must never be interpreted as:

  • financial, investment, or trading advice;
  • personalized or tailored recommendations of any kind;
  • a recommendation, endorsement, solicitation, offer, or inducement to buy, sell, hold, or otherwise transact in any cryptocurrency, currency pair, security, derivative, token, or other financial instrument or asset;

3. No Advisory, Fiduciary, or Brokerage Relationship

Your use of the Service does not create any advisory, fiduciary, agency, partnership, employment, or brokerage relationship between you and HyperFX.

HyperFX is NOT, and does not hold itself out to be:

  • a broker, dealer, or broker-dealer;
  • a cryptocurrency or securities exchange, trading venue, or marketplace;
  • a financial advisor, investment advisor, or investment manager;
  • a fund, money manager, or custodian of client assets;
  • a fiduciary; or
  • an introducing broker.

We do not execute trades, hold or manage your funds or assets, accept deposits, or transmit money. We owe you no fiduciary duty, and you should not place reliance on us as if we did.

The purchase of any subscription, lifetime plan, or analysis credit pack, or payment of any fee (including cryptocurrency payments processed through a third-party, non-custodial crypto payment processor), is consideration for access to information and educational features only. It does not convert the Service into a regulated, advisory, fiduciary, or brokerage product, does not create any such relationship, and does not entitle you to any guaranteed result.

4. Not Regulated or Authorized

HyperFX makes no claim of any regulatory authorization anywhere on the Service. HyperFX is NOT regulated, licensed, registered, supervised, endorsed, or authorized by any financial regulator, securities authority, or government agency in any jurisdiction (including, without limitation, the SEC, CFTC, NFA, FCA, ESMA, or any national competent authority under MiCA or equivalent frameworks).

Any statement, anywhere on the Service, that could suggest regulated, licensed, or authorized status is void and of no effect unless it is contained in a formal regulatory disclosure expressly designated as such by HyperFX.

The Service is intended as an information and education product only and is not a regulated financial service. The absence of regulatory authorization means you may not benefit from the protections (such as compensation schemes or ombudsman services) that apply to regulated financial firms.

5. Jurisdictional Restrictions and Eligibility

The Service is not directed to, and may not be used by, any person in any jurisdiction where the provision or use of the Service, or where trading in crypto-assets or forex, is unlawful or restricted, or where doing so would subject HyperFX to any registration or licensing requirement.

You are solely responsible for determining whether your access to and use of the Service is lawful in your country and location, and for complying with all applicable local laws, regulations, and tax obligations. If access is prohibited where you are located, you must not use the Service. You access the Service on your own initiative and at your own risk.

You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) and legally permitted to use the Service. The Service is not intended for minors.

Jurisdiction-specific risk warnings. Certain jurisdictions prescribe specific, mandatory risk warnings for high-risk products such as leveraged crypto-assets, forex, contracts for difference (CFDs), or similar instruments (for example, prescribed standardized wording and loss-percentage disclosures required in the EU, the UK, and elsewhere). You acknowledge and accept the following risks, which are illustrative and not exhaustive:

7. No Guarantees, No Typical Results

HyperFX makes no guarantees, representations, or warranties of any kind regarding profits, returns, accuracy, performance, or any other outcome.

  • No profit guarantee. We do not and cannot guarantee that use of the Service, the Content, any analysis, any strategy, or any setup will be profitable, will avoid losses, or will produce any particular result. Any suggestion to the contrary should be disregarded.
  • Past performance is not indicative of future results. Historical, illustrative, hypothetical, simulated, or back-tested performance figures are not a reliable indicator of future performance and should not be relied upon as such.
  • Hypothetical and simulated results have inherent limitations. Where any back-tested, simulated, or hypothetical results are shown, you must understand that they do not represent actual trading, were prepared with the benefit of hindsight, involve no real capital at risk, and may not reflect the impact of real market conditions, fees, slippage, or liquidity. 9. AI-Assisted Analysis — Limitations and Possibility of Errors

The Service includes artificial intelligence and automated tools, including AI-assisted analysis of user-uploaded chart screenshots and related outputs (the "AI Output"). You acknowledge and accept the following:

  • AI Output may be wrong. AI Output may be incomplete, inaccurate, outdated, biased, or simply incorrect. It may appear confident, authoritative, or precise while still being mistaken ("hallucinations"). Accuracy, reliability, and completeness are not guaranteed.
  • No market prediction. No AI system, model, or tool can predict markets, prices, or outcomes with any certainty. Models may underperform or fail entirely under certain market conditions, and may be affected by the quality of the underlying chart, image, or data submitted.
  • Dependence on inputs and data sources. AI Output depends on the data, images, and information provided to or available to it, which may themselves be flawed, incomplete, delayed, or erroneous. Errors in inputs will produce errors in outputs.
  • An aid, not advice. AI Output is an informational aid only. It is not financial, investment, or trading advice and is not a substitute for your own judgment or for advice from a qualified professional.

10. User-Supplied Data and Trade Journal

Many features of the Service depend on information that you provide, including chart screenshots you upload and trade data, entries, notes, and parameters you enter yourself ("User Inputs").

  • Outputs depend on your inputs. AI Output, trade journal analytics, statistics, performance summaries, and any derived metrics are generated from your User Inputs and are only as accurate, complete, and reliable as those inputs. Inaccurate, incomplete, mislabeled, low-quality, ambiguous, or out-of-date User Inputs will produce correspondingly inaccurate or misleading outputs.
  • Your responsibility for accuracy. You are solely responsible for the accuracy, completeness, legality, and timeliness of all User Inputs.
  • No responsibility for input-driven errors. HyperFX does not verify your User Inputs and is not responsible or liable for any AI Output, analytics, journal results, or other outputs that are inaccurate, incomplete, or misleading as a result of inaccurate, incomplete, or otherwise deficient User Inputs.

11. "Trader Intelligence" — Trader Accuracy Tracking

The Service may include a feature that tracks, records, scores, and presents the publicly stated predictions, calls, opinions, or commentary of public figures, including traders, analysts, and content creators ("Trader Intelligence").

You acknowledge and accept the following regarding Trader Intelligence:

  • Factual commentary based on public statements. Trader Intelligence consists of factual reporting, commentary, analysis, and statistical evaluation based on statements that the relevant individuals have themselves made publicly available (for example, on YouTube, social media, or other public channels). Where reasonably practicable, entries are accompanied by references or sources identifying the underlying public statement, and accuracy assessments are based on historical records and back-tested or after-the-fact evaluation against observable market data.
  • Opinion, fair comment, and good faith. Any evaluative statements (such as accuracy scores or commentary) represent our or the platform's good-faith opinion and analysis based on disclosed sources and methodology. They are intended as fair comment on matters of public interest and are not intended to defame, disparage, or harm the reputation of any individual, and should not be read as statements of dishonesty or wrongdoing.
  • Not an endorsement. The inclusion, ranking, scoring, or tracking of any individual is not an endorsement, recommendation, certification, or approval of that individual, their predictions, their content, or any product or service they offer. Equally, a low or unfavorable score is not an assertion of bad faith on their part.

HyperFX, its operators, owners, directors, officers, employees, contributors, and affiliates may, from time to time, hold, acquire, increase, reduce, or dispose of positions or interests in cryptocurrencies, currency pairs, tokens, or other assets that are referenced, analyzed, tracked, or otherwise mentioned in the Content, the feeds, or the AI Output.

  • Such positions and interests are not disclosed on a per-item basis.
  • The existence of any such position is not a recommendation, solicitation, endorsement, or inducement to buy, sell, or hold any asset.
  • Any view or analysis expressed in the Content may differ from, or be contrary to, the positions actually held by HyperFX or the persons described above, and those positions may change at any time without notice.

These potential conflicts reinforce, and do not detract from, the no-advice, no-solicitation, and no-endorsement positioning set out elsewhere in this Disclaimer.

13. Third-Party Content, Data, and Links

The Service may display, reference, summarize, parse, aggregate, or link to content, data, opinions, and materials originating from third parties, including market data feeds, exchanges, brokers, news, and content parsed or summarized from third-party platforms such as YouTube ("Third-Party Content").

  • We do not create, own, control, endorse, guarantee, or accept responsibility for Third-Party Content, and we do not warrant its accuracy, completeness, timeliness, legality, or fitness for any purpose.
  • Third-Party Content reflects the views of its authors, not of HyperFX.
  • Links to third-party websites, brokers, exchanges, or services are provided for convenience only. We have no control over, and accept no responsibility for, the content, products, services, security, policies, or conduct of any third party. Accessing third-party sites and services is at your own risk and subject to their terms.

14. Affiliate and Referral Disclosure

In the interests of transparency, and in line with applicable advertising and consumer-protection standards (including FTC guidance):

We do not warrant the accuracy, completeness, currency, or reliability of any Content, data, AI Output, or results obtained through the Service.

17. Service Availability and Force Majeure

The Service is provided on an "as available" basis and may be unavailable, interrupted, delayed, suspended, degraded, or discontinued at any time, with or without notice, including for maintenance, updates, technical failures, third-party data or infrastructure failures, or events beyond our reasonable control.

You acknowledge that much of the Content is time-sensitive and that outages, latency, downtime, or interruptions may mean Content, data, feeds, or AI Output are stale, delayed, incomplete, or unavailable at the moment you need them — which, in volatile crypto and forex markets, can be significant.

To the fullest extent permitted by applicable law, HyperFX shall not be liable for any unavailability, interruption, delay, suspension, or discontinuation of the Service or any Content, nor for any failure or delay in performance, where caused directly or indirectly by any event or circumstance beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, governmental or regulatory action, changes in law, labor disputes, power or telecommunications failures, internet or hosting failures, third-party service or data-provider failures, exchange or market outages, cyberattacks, or denial-of-service events.

18. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall HyperFX, its affiliates, or their respective directors, officers, employees, agents, partners, suppliers, or licensors be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, capital, data, goodwill, or trading or investment losses, arising out of or in connection with your use of (or inability to use) the Service, the Content, the AI Output, or any reliance placed on any of them, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.

Where liability cannot lawfully be excluded, it is limited to the maximum extent permitted by applicable law, and the total aggregate liability of HyperFX shall not exceed the amount you paid to HyperFX (if any) for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in this Disclaimer excludes or limits liability that cannot be excluded or limited under applicable law.

19. Indemnification

You agree to defend, indemnify, and hold harmless HyperFX and its affiliates and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your access to or use of the Service, your trading or investment decisions, your reliance on any Content or AI Output, or your breach of this Disclaimer or applicable law.

20. Severability

If any provision of this Disclaimer is held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if it cannot be so modified, severed from this Disclaimer. The invalidity, illegality, or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

21. No Waiver

No failure or delay by HyperFX in exercising any right, power, or remedy under this Disclaimer shall operate as a waiver of that or any other right, power, or remedy, and no single or partial exercise of any right, power, or remedy shall preclude any further exercise of it or the exercise of any other right, power, or remedy. Any waiver must be express and in writing to be effective.

22. Entire Agreement and Order of Precedence

This Disclaimer, together with the Terms of Service and the other policies referenced in Section 1 (including the Privacy Policy, Cookie Policy, and Refund Policy), constitutes the entire agreement between you and HyperFX in relation to its subject matter and supersedes any prior understanding or arrangement on that subject matter.

This Disclaimer is incorporated into and forms part of the Terms of Service. In the event of any conflict or inconsistency between this Disclaimer and the Terms of Service specifically regarding disclaimers, risk warnings, the no-advice positioning, or limitations of liability, this Disclaimer shall prevail to the extent of that conflict. In all other respects, the Terms of Service shall prevail.

23. Changes to This Disclaimer

We reserve the right to modify, update, or replace this Disclaimer at any time in our sole discretion. The "Effective date" above indicates when this Disclaimer was last revised. Material changes may be communicated through the Service. Your continued use of the Service after any change constitutes your acceptance of the revised Disclaimer.

This Disclaimer is governed by and construed in accordance with the laws of the jurisdiction in which the owner of hyperfx.pro is established, without regard to its conflict-of-laws principles, and subject to any mandatory consumer-protection rights available to you under the laws of your country of residence.
