We provide this summary up front, in clear and conspicuous language, so that you are informed of our material commercial connections before you click any link or make any decision. The remainder of this document explains these disclosures in full.

Any incentive, bonus, promotion, or discount that a Partner may offer to users who sign up through a referral link is offered, controlled, and funded solely by that Partner. HyperFX does not promote, sponsor, recommend, or endorse any such incentive. Such incentives may be unavailable, restricted, or prohibited in certain jurisdictions, and you are responsible for confirming whether any incentive is lawfully available to you.

2. About HyperFX and This Disclosure

HyperFX is an information and educational platform only. We offer AI-assisted analysis of user-uploaded chart screenshots, a trade journal, strategy and setup feeds, and tracking of public traders' prediction accuracy, covering the cryptocurrency and forex markets.

HyperFX is not a broker, exchange, dealer, financial advisor, investment adviser, or fiduciary, and is not regulated or authorized by any financial authority unless expressly stated in writing. We provide no financial, investment, or trading advice, no personalized recommendations, and no solicitation or offer to buy or sell any asset. Nothing in this Affiliate Disclosure, and nothing reached through any link on our platform, should be understood as such advice or as a recommendation to use any particular service.

This Affiliate Disclosure explains:

  • that we participate in broker and exchange referral and affiliate programs and may earn commissions;
  • how affiliate links are identified;
  • that earning a commission is at no additional cost to you;
  • that our commercial relationships are not endorsements or recommendations;
  • that our financial interest is a conflict of interest you should account for;
  • your responsibility to evaluate any third party independently; and
  • the advertising and disclosure standards we follow.

3. Our Participation in Affiliate and Referral Programs

We participate in affiliate, referral, partner, and similar marketing programs operated by third parties, including cryptocurrency exchanges, forex brokers, trading platforms, and related service providers (collectively, "Partners").

When we include a link, banner, button, code, or other reference to a Partner, that reference may be an affiliate or referral link. If you click such a link and subsequently take a qualifying action — such as registering an account, verifying your identity, depositing or funding an account, placing trades, paying fees, or maintaining activity over time — we may receive compensation. This compensation may take various forms, including:

  • one-time referral or sign-up bounties;
  • recurring commissions;
  • a share of spreads, trading fees, or commissions generated by referred users (including revenue-share or "rebate" arrangements);

4. No Additional Cost to You

Partner incentives and bonuses may be unavailable, restricted, or prohibited in certain jurisdictions — including under financial-promotion and inducement rules that restrict or ban incentives to invest in crypto-assets or to trade high-risk products — and you are solely responsible for confirming whether any incentive is lawfully available to you before relying on it.

5. How Affiliate Links Are Identified

We mark affiliate and referral links clearly and conspicuously so that you can recognize them before you act. Depending on the context, we identify such links and relationships through one or more of the following:

  • a notice placed immediately adjacent to the relevant link or button (for example, labels such as "affiliate link", "referral link", "partner", "ad", or "sponsored");
  • a disclosure shown adjacent to lists, comparisons, or feeds that contain Partner links;
  • this Affiliate Disclosure, which is linked in the site footer site-wide; and
  • repeated, in-context reminders on pages that prominently feature broker or exchange links.

We disclose our material connection clearly and conspicuously, immediately adjacent to the relevant link and in a position where you are likely to see it before clicking or making a decision. 6. A Commercial Relationship Is Not an Endorsement or Recommendation

The fact that we have an affiliate or referral relationship with a Partner, or that we earn compensation from it, does not mean:

  • that we endorse, recommend, or vouch for that Partner;
  • that the Partner is suitable, safe, reputable, solvent, or appropriate for you;
  • that the Partner is the best or only option available; or
  • that we provide any financial, investment, or trading advice by listing or linking to it.

Conflict of interest. Our compensation arrangements give us a direct financial interest in users signing up with, funding, and trading through Partners. This is a conflict of interest. That financial interest may influence which Partners we feature, the order or prominence in which they appear, or how frequently they are mentioned. We do not warrant that any affiliate-related information is correct, current, or complete, and we are not obliged to update it. You rely on such content entirely at your own risk.

8. Your Responsibility to Evaluate Third Parties Independently

Before opening an account with, depositing funds into, or trading through any Partner, broker, exchange, or other third party, you are solely responsible for conducting your own independent research and due diligence. You should, at a minimum, consider:

  • the Partner's regulatory status, licensing, and the jurisdiction(s) in which it operates;
  • its reputation, security practices, custody and safeguarding of funds, and track record;
  • its fees, spreads, leverage, margin requirements, and withdrawal terms;

9. Eligibility, Age, and Restricted Jurisdictions

Adults only. Our platform and the broker, exchange, and trading services to which we link are intended solely for adults who are of the legal age of majority in their jurisdiction (at least 18 years old, or older where a higher age applies) and who are otherwise legally eligible to access such services. The platform and any linked Partner are not intended for, and must not be used by, minors. By using our platform or any affiliate or referral link, you represent that you meet these eligibility requirements.

Restricted jurisdictions and persons. Many Partners restrict or prohibit access based on the user's country, residency, or status. Certain Partners, products, promotions, or features are not available to persons in particular jurisdictions, including, depending on the Partner, U.S. persons and persons located in, or who are nationals or residents of, sanctioned, embargoed, or otherwise restricted territories. 10. Affiliate Tracking, Cookies, and Identifiers

When you click such a link, the Partner or an intermediary network may set cookies, store tracking identifiers (such as a referral ID or click ID), or otherwise record that you arrived through HyperFX, in order to attribute any qualifying action to us and calculate any commission. This may involve the transfer of certain information, such as referral identifiers, to the Partner or network.

Partners are independent controllers of any data they collect, and their handling of your data is governed by their own privacy policies, not by ours.

11. Third-Party Services Carry Their Own Risks

Partners are independent third parties over which we have no control. We do not operate, manage, audit, or supervise any Partner, and we are not responsible for their conduct, products, services, security, availability, solvency, or compliance with applicable law. Your use of any Partner is governed exclusively by the agreement between you and that Partner, and is undertaken at your own risk.

In addition, you should be aware of the inherent risks of the underlying markets:

  • Trading cryptocurrency and forex is high-risk and is not suitable for everyone. You can lose some, all, or — where leverage or margin is involved — more than your initial capital.
  • Leverage magnifies losses as well as gains.
  • Crypto and forex markets can be extremely volatile, and prices can move sharply and rapidly against you.
  • Past performance does not indicate or guarantee future results. No outcome, profit, or level of accuracy is guaranteed by HyperFX or by any Partner, and there is no such thing as a "typical" result.
  • AI-assisted output may be inaccurate, incomplete, or wrong, and must be independently verified by you before you rely on it for any purpose.
  • Funds held at third-party brokers or exchanges may not be insured or guaranteed against loss, theft, misappropriation, or insolvency.

Broker insolvency and disputes. HyperFX is not responsible for, and provides no assistance, recovery service, or guarantee in relation to, any failure, default, insolvency, or loss of funds at any Partner. HyperFX is not a party to, and will not mediate, intervene in, or resolve, any dispute, complaint, or claim between you and any Partner. Any such matter is solely between you and the Partner, and you must pursue it directly with the Partner or through the appropriate regulatory or legal channels.

To the fullest extent permitted by applicable law, HyperFX accepts no liability for any loss or damage — direct, indirect, incidental, special, consequential, or otherwise — arising from your dealings with, reliance on, or use of any Partner or other third party, including any losses sustained through trading. 12. Tax Responsibility

You are solely responsible for determining, reporting, and paying any and all taxes, duties, levies, and similar charges arising from or in connection with your use of any Partner, including any income, gains, losses, fees, rebates, bonuses, or other amounts associated with registering, funding, or trading through a Partner. HyperFX does not provide tax advice and makes no representation regarding the tax treatment of any activity. You should consult a qualified and licensed tax professional regarding your specific circumstances.

13. Advertising and Disclosure Compliance

We comply with applicable advertising, marketing, and disclosure standards regarding affiliate and referral relationships, including the principles reflected in U.S. Federal Trade Commission (FTC) guidance on endorsements and the disclosure of material connections, and analogous consumer-protection and advertising rules in other jurisdictions. Consistent with these principles, we:

  • disclose our material commercial connections clearly and conspicuously;
  • place affiliate disclosures immediately adjacent to the relevant links and where they are hard to miss, rather than buried;
  • make disclosures in plain language before you click or make a decision; and
  • avoid implying that compensation equates to an endorsement, or that any result is typical or guaranteed.

HyperFX provides this Affiliate Disclosure in multiple languages (English, Russian, and Spanish). If there is any conflict or inconsistency between translated versions, the English version shall prevail to the extent permitted by applicable law.
